
What is it?
A full bespoke Mental Capacity Assessment carried out by a registered healthcare professional. This will assess a person’s capacity to make a specific decision which may include but is not limited to, one of the following:
- COP3 part B – Specific Mental Capacity Assessment(s) for the Court of Protection
- Make or amend a Will (Testamentary Capacity)
- Assign or revoke a Lasting Power of Attorney (LPA)
- Litigate, also referred to capacity to conduct court proceedings
- Make treatment decisions
- Make a gift / give a substantial donation
- Management of property and finances
- Decide living arrangements
Requirements
In order for us to carry out a Mental Capacity Assessment, you will need to provide:
- A clear specific decision to be addressed (we are happy to help you identify this question if required)
- Once this question has been identified, we will send you a list of information that should be provided to us prior to the assessment date, without which, the assessment cannot proceed
- If the referral is from the person to be assessed (i.e. the person, ‘P’), the information provided needs to be verified by a third party, such as a solicitor or similar professional
- You should also make us aware of any risks associated with the assessment venue including works going on, dogs (etc.)
Assessment process
As part of the assessment you will receive:
- Letter/email with information on what to expect
- A full Mental Capacity Assessment for a specific decision
- Full report, validated and signed by a registered healthcare professional
- Sent via post and as an electric copy
- Optional debrief either by phone or in person (travel costs may apply)
In most cases the person being assessed will be debriefed on the day of the assessment. For complex cases, a debrief may be offered at a later date once professional analysis of the assessment and consultations has taken place.
Pricing
Standard assessments
- £300 per test + travel time at £30 per hour (including a reduced rate of time taken by the professional and petrol)
Please note: these prices include administration costs, information gathering, preparation for assessment, travel time, consultations, assessment completion, report writing and any associated follow-up work.

Additional notes
- Our Mental Capacity Reports are completed to a Court Standard.
- If certificates or witness signatures are requested, we will only complete this with the direct instruction and presence of a solicitor to act as the second witness. This will be at an additional cost to be confirmed. Please note that this is an optional extra to the core service of Mental Capacity Assessment, training and consultancy, being provided at the agreement of all appropriate parties.
- If you have additional requests, or require a change of provision (such as to include an additional Assessment) after an Assessment has been booked, you need to alert us to this at least five working days prior to the Assessment date, in order to give us time to prepare. Changes must be agreed in writing from a member of our team.
- Additional charges may be necessary if several visits are required.
