There are many fantastic resources available to support capacity, provide valuable learning resources and updates for practice. Since we published our last blog on this topic, several new items have been published. We’ve listed some of our favourite free mental capacity resources below…
- There is a new website for reporting concerns about an Attorney, Deputy or Guardian to the Office of the Public Guardian (OPG).
- The Office of the Public Guardian (OPG) has released Guidance for property and affairs deputies, published 9th January 2026.
- Learning from Lives and Deaths of people with learning disability and Autistic people (LeDer) report for 2023, published January 2026.
- Professional Deputies Forum, published a blog on the 6th January 2026 regarding ‘Accessible information and communication tools to support deputies. This includes a link to a Coalition Project report from July 2024, ‘Making legal Services more Accessible’.
- An alternate easy read document regarding Deprivation of Liberty Safeguards was shared from Surrey County Council, October 2025.
- NHS England published a new guidance in October 2025 regarding Identifying Restrictive Practices.
- Royal College of Emergency Medicine, Learning Disabilities Toolkit
- This is aimed at emergency workers and includes a range of Makaton-style pages to give visuals to help explain, inform and support questions.
- It would be a useful toolkit for any family or support staff aiding people who have communication challenges in attending Accident and Emergency, or similar roles.
- NHS England: Guidance to support implementation of Mental Capacity Act in Acute Trusts for Adults with Learning disabilities
- The guidance can be downloaded as a PDF, and of particular use from this section is the downloadable practical tools and resources.
- National Centre for Cross Disciplinary Social Work, Bournemouth University: Mental Capacity Resources
- Here is a range of downloadable, printable leaflets on a range of matters, from ‘Advanced decisions to Refuse Treatment (ADRT)’ to ‘Next of kin: Understanding decision making authorities’.
- SCIE: Get me to hospital
- This resource is aimed at family and staff who need to go to hospital who have a cognitive impairment, considering supporting decision making and application of the Mental Capacity Act (2005).
- British Medical Association, Ethics Toolkit, Treating 16 and 17 year olds in England, Wales and Northern Ireland.
- This toolkit is primarily aimed at health care professionals, being a useful reference tool for ethical decisions, including those related to capacity.
- Alcohol Change UK: How to use legal powers to safeguard highly vulnerable dependent drinkers
- This guide is produced for health care practitioners working alongside person(s) who are vulnerable, chronically dependent drinkers.
