Following an announcement by the Department of Health on Thursday 16th December 2021, the long awaited release of the Liberty Protection Safeguards has again been postponed.
The proposed legislation changes were originally passed in 2019, with implementation scheduled to start in October 2020. Due to a range of complex factors, this was been pushed back several times, with the most recent set release being April 2022. However, it has again been postponed, and we have no clear date yet for when the changes will come into force.
The Department of Health claims the delay is in the best interest of the successful application in practice. However, only time wil tell the impact yet another delay to this essential legislation will have.
